These Terms and Conditions ("Terms") govern your use of our website [www.fleurdemochi.com] and any purchase of products from Fleur de Mochi. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Introduction

Fleur de Mochi provides premium, perishable food products. These Terms describe your rights and obligations and our commitments when you use the Site or purchase from us.

2. Eligibility

By using the Site you confirm you are at least 18 years old and legally able to enter contracts. Users under 18 may use the Site only with the involvement of a parent or legal guardian who accepts these Terms.

3. Products, Pricing & Payment

3.1 Product Information.
We aim for accurate descriptions and images. Minor variations (e.g., color, decoration) may occur due to artisan production.

3.2 Availability.
All products are subject to availability. We may limit quantities, offer substitutions (with your consent), or cancel orders we cannot fulfill.

3.3 Prices & VAT.
Prices are in AED and may change without notice. Prices are inclusive/exclusive of VAT as stated at checkout. If a pricing/display error occurs, we may cancel the order or contact you to confirm the correct price before proceeding.

3.4 Payment.
We accept the payment methods shown at checkout. You agree to provide current, complete, and accurate billing/contact details and authorize us or our payment partners to charge the full order amount, including taxes and delivery fees.

3.5 Security.
Payments are processed via trusted gateways; card data is handled by those gateways in line with applicable security standards (e.g., PCI DSS).

4. Ordering Process

4.1 Order Confirmation
After checkout you’ll receive an email/SMS confirmation. This acknowledgment does not constitute acceptance; acceptance occurs when we dispatch or otherwise confirm the order.

4.2 Changes/Cancellations by You.
Because our products are fresh and made to order, changes or cancellations may be possible up to 1 hours before your selected delivery slot (or production start), subject to our confirmation. After this window, the order is considered final.

5. Shipping & Delivery

5.1 Delivery Areas.
We currently deliver within selected zones in Dubai. Orders outside our coverage may be declined or may incur extra time/fees.

5.2 Delivery Times.
Standard Dubai delivery typically within 1–3 hours from the confirmed slot. Times are estimates and may vary due to preparation, traffic, courier capacity, weather, or events.

5.3 Access & Attempts.
Ensure someone is available to receive the order and that we have accurate address/access details. If no one is available, re-delivery or alternate drop may be charged or the order may be cancelled without refund if the product is no longer safe to deliver.

5.4 Risk & Title.
Risk in products passes on delivery to the address or person you designate. Title passes upon full payment.

5.5 Handling.
Products should be refrigerated promptly per instructions on the packaging. We are not liable for spoilage or quality degradation after successful delivery due to improper handling or storage.

6. Returns, Replacements & Refunds (Perishables)

6.1 No Returns.
Due to the perishable nature of our products, returns are not accepted.

6.2 Issues on Delivery.
If your order arrives incorrect, incomplete, or damaged, contact us within 2 hours of delivery at +971 552 089 200 (with photos and your order number).

6.3 Resolution.
At our discretion, we may offer a replacement, partial/full credit, or refund. Decisions are case-by-case and consider product type, proof of issue, and timing of the report.

6.4 Non-Eligible Cases.
We cannot replace/refund where issues arise from (a) incorrect delivery information provided by you, (b) failure to receive the order, (c) handling/storage after delivery, or (d) requests made after the 1-hour window.

7. Allergens & Ingredient

Our products may contain or come into contact with: milk, nuts (including peanuts), gluten, soy, sesame, and eggs. Cross-contact can occur in shared facilities.It is the customer responsibility to contact us before ordering for specific allergen concerns. By ordering, you acknowledge these risks.

8. Promotions, Gift Messages & Gift Cards

8.1 Promo Codes
One code per order unless stated; non-transferable; cannot be exchanged for cash; subject to expiry and terms stated in the offer.

8.2 Gift Messages.
You are responsible for content legality and appropriateness. We may refuse messages we deem offensive or unlawful.

9. User Content & Reviews

If you submit reviews, photos, or feedback, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content for marketing and service improvement, in accordance with applicable laws. You confirm you own or control the rights to the content you post.

10. Intellectual Property Rights

All Site content—including text, images, videos, product names, logos, and trademarks—is owned by or licensed to FDM and protected by applicable IP laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.

11. Prohibited Uses

You agree not to:
- use the Site for unlawful, fraudulent, or harmful purposes;
- attempt to gain unauthorized access to systems or data;
- introduce malware, spam, or disruptive code;
- interfere with Site functionality, security, or other users’ experience.

12. Privacy & Cookies

12.1 Privacy.
We collect and process personal data to fulfill orders, provide customer support, and improve our services. We do not sell or rent your data. We may share data with trusted partners (e.g., payment gateways, couriers) under appropriate safeguards. You may request access, correction, deletion, or objection by contacting us at info@fleurdemochi.com.

12.2 UAE Laws.
We aim to comply with applicable UAE data protection requirements (including, where applicable, Federal Decree-Law No. 45 of 2021 on Personal Data Protection).

12.3 Cookies.
We use cookies/analytics to operate and enhance the Site. You can manage preferences via your browser; some features may not function without certain cookies.

12.4 E-Communications.
By providing contact details, you consent to receiving order updates and service communications. Marketing messages are optional; you can unsubscribe at any time.

13. Warranties, Liability & Indemnity

13.1 “As Is”.
The Site and products are provided “as is” to the fullest extent permitted by law.

13.2 Limitation.
To the maximum extent permitted by law, FDM is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption. Our total aggregate liability for any claim related to an order is limited to the amount you paid for that order.

13.3 Indemnity.
You agree to indemnify and hold FDM harmless from claims, damages, liabilities, costs, and fees arising from your breach of these Terms, unlawful use of the Site, or violation of third-party rights.

14. Force Majeure

We are not liable for delays or failure to perform due to events beyond our reasonable control, including but not limited to accidents, extreme weather, traffic disruptions, governmental actions, internet failures, supply interruptions, or courier constraints.

15. Suspension & Termination

We may suspend or terminate access to the Site (in whole or part) if we reasonably believe you violated these Terms or applicable law. Your obligations that by nature should survive (e.g., IP, disclaimers, limitations, indemnity) will continue after termination.

16. Changes to the Site or Terms

We may update the Site and these Terms from time to time. When we do, we will revise the Effective Date above. Continued use of the Site after changes signifies acceptance of the updated Terms.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates. The courts of Dubai, UAE shall have exclusive jurisdiction over disputes, without prejudice to any mandatory consumer protections under applicable law.

18. Miscellaneous

18.1 Severability.
If any provision is found invalid or unenforceable, the remaining provisions remain in full force.

18.2 No Waiver.
Failure to enforce any provision is not a waiver of our rights.

18.3 Assignment.
You may not assign your rights without our prior written consent; we may assign to an affiliate or in connection with a reorganization or sale.

18.4 Entire Agreement.
These Terms make up the entire agreement for your use of the Site and purchase of products.
